HUD Day/Night Noise Requirements

Does anyone have any experience with the HUD Day/Night Noise Level Requirements? (DNL).

We're working on a 350+ unit redevelopment project in an urban area in the Midwest and based on our sound consultant, we believe we're going to fail due to noise levels. We can replace all the windows due to the increase in cost.

Does anyone have experience working with a consultant on ways to get around / satisfy these requirements in a relatively cost-effective manor?

There is potential to apply for a variance, but that would tack on at least 3-months to run through that process with HUD.

You said redevelopment but then you mention replacing windows- so I assume that this is a conversion of an office to apartments?  

Assume you're trying to do a 221d4?   If so you have you had a concept meeting, and did you discuss this?

I assume that the noise was tested with physical equipment due to the multiple readings you gave?  Or just calculated using the HUD worksheet?  

If the latter, did the noise consultant do the worksheets too?

The physical testing isn't required - we usually only do it when the worksheets using the traffic/train/airplane data don't give us the result that we want (sub 75).

Have you done a Phase I besides this?   Did the Phase I reviewer fill out the noise worksheet too?   What firm was it?

As is, you're unlikely to get approved from CPD for a waiver (although you'll need to ask HUD/your lender) and if you do it will probably be greater than 3 months and you have to show interior noise levels are mitigated by 45 (usually a non-issue even with old windows) and that there's no outdoor amenity space. 

Does the project have an affordability component?
